TRUE IDENTITY TERMS OF SERVICE
Our Services
True Identity Alert Service (“True ID” or the “Service”) is a phone service provided by Iyconsoft Nigeria Limited (“Service Provider”) that renders phone community services to users (“Users” or “You”). Our services come in two variants: Data Free and Data enabled Model.
Our Data Free Model is accessible via network channels (USSD, SMS) and operates by offering true identity services to subscribers on the mobile operator network (“Network Provider”). The Data Enabled Model requires the download of our software. These Terms of Service will govern the use of TrueID’s service by users on any of the models. Our services include the provision of incoming caller identification, call history, online phonebook service, caller identity search.
By accessing or using any of the sservices, you agree to be bound by these terms. By using the data free model, you confirm that you are resident in Nigeria and that you accept to be bound by these Terms. Certain features of the services may be subject to additional guidelines, terms or rules, which will be posted in or on the services in connection with such features. You can opt for the data free or data enabled model. Our data free model is provided through a text-based caller identity alert of incoming callers.
Data free model: You can access our data free model by subscribing to the service through the specified network provider. You will then be provided a SMS link that directs you to these terms of service. Our data free model is compatible with all phone types and operates through a text-based notification that provides you with the identity of your callers from our database sources while a call is incoming and also saves the identity of your callers in an offline contact list. You do not require any data connection to access this service and this service can identify spoof calls.
Data enabled model: You can access our data enabled model by downloading our mobile software application on your mobile device and providing the mandatory data to access our services. You will require an internet connection on an enabled phone to use this service. The mobile application pops up a notification of the identity of your callers while a call is incoming. The identity of your callers is saved on an online Phonebook book service where you can have access to our intuitive generated online phone book that can be accessed from the cloud
User Privacy
The privacy of our users is important to us. It is our policy to ensure that they are protected hence our commitment to the security of their personal information. Please see the TrueID Privacy Statement which describes the types of data we collect from users and how we use such Data. Where data sharing is based on consent, by agreeing to these Terms, you consent to Iyconsoft’s data sharing with third parties as described in the Privacy Statement.
Proprietary Rights
All title, ownership rights and intellectual property rights in and to the content and services and any copy thereof, are owned by Iyconsoft Nig. Limited. The services are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. You are granted only a limited right to use the services subject to these terms and no intellectual property rights are or will deemed to be transferred or licensed to Users. The content and services contain licensed materials and the service provider, and its affiliates shall protect their rights in the event of any violation of this Agreement.
Grant of Right
The service provider agrees to grant users a personal, non-transferable and, non-exclusive right to the use of its phone services. Users shall not use the services on any device that do not belongs to them neither shall they utilize the service for commercial purposes.
You are not granted any right to use the TrueID’s name, trademarks or other commercial symbols as they are owned by Iyconsoft Nig. Limited. All rights not expressly granted to users under these Terms shall be retained by the service provider.
Support
The service provider agrees to provide adequate and efficient technical support, upgrades and updates for the services. The service provider shall not be responsible for inaccessibility to the services due to the network fluctuation or failure of the network provider.
Services or Software Update
The service provider may change the sservices at any time, by adding or removing features. The service provider also reserves the right to modify these terms at any time by providing revised terms to the Users through the network provider or by publishing the revised Terms within the services. In case of material changes, the User shall always be notified thereof and provided the option to immediately terminate the services by unsubscribing from the services or uninstalling the software as the case may be.
The service provider may need you to update the software in other to keep using the services. We may automatically check your version of the software and download changes. The service provider isn’t obligated to make any updates available and doesn’t guarantee support for the version of the operating system which is incompatible with software or services provided by third parties. Disclaimer
The service provider makes no guarantee as to the accurateness, quality, or completeness of any caller information provided on the App and the Service Provider shall not be responsible or liable for any errors, omissions, or inaccuracies in the information or for any user’s reliance on the information.
Users will be solely liable for any content that they communicate directly in or on the Services and shall only post or communicate content that:
is true and not false or misleading;
belongs to them, or which they have a right to distribute;
does not constitute an infringement of the intellectual property or privacy rights of any third party;
does not constitute information that they are not legally entitled to distribute (such as insider information or confidential information);
is accurate, fair, and is not disparaging of us, the services or other Users. Further, Users agree to be fair, accurate and non-disparaging while reporting numbers, leaving comments, suggestions, feedback, testimonials and reviews on or about the services.
The service provider shall be notified of any objectionable user generated content posted or communicated by a User directly in or on the services. Please contact us at [email protected] to report any objectionable user generated content. TrueID hereby reserves the right in its absolute discretion to remove any user generated content from the services.
Fees
TrueID offers features or services for which a fee will be payable (“Paid Services”). Our data-free model is priced N10/day and N50/7 days on the Network Provider network. The pricing may differ based on Mobile operator. Users will be charged the applicable fees unless they cancel the paid service, in which case You agree to still pay these fees through the end of the applicable subscription period. We may change the TrueID Fees from time to time by posting the changes in or on the services or by notifying You in advance. All fees are, except as otherwise expressly provided herein or as required by applicable law, non-refundable. Failure to pay these fees may result in suspension or termination of our service or your subscription.
Prepaid fees for the services are connected to the User’s phone number. Therefore, in some cases, if Users change the device or its SIM-card, they cannot transfer the balance to a new device or SIM-card and no refund will be available in such cases. Any remaining balance of prepaid fees not used will expire without any right of refund
Warranty Disclaimer
EXCEPT AS WRITTEN IN THIS AGREEMENT, THE SERVICE IS PROVIDED “AS IS”
The service provider does not warrant, guarantee, or make any representations regarding the use, or the results of the use, of the service or written materials in terms of correctness, accuracy, reliability, currentness or otherwise. The entire risk as to the results and performance of the service is at User’s risk and not by Iyconsoft Nig. Limited.
Users agree that the services may be unavailable from time to time and that TrueID will not be liable for User’s inability to use the services for whatever reason. The service provider does not warranty the availability of the service in every location.
Termination
Your right to use the services continues upon subscription until these terms are terminated by unsubscribing from the services. The service Provider may terminate the Terms and use of the services at any time by advance notice to the users. Upon any termination, User agree to cease using the services and the network provided shall cease to render the services to them. Upon termination by Users, or by the service provider due to the User’s breach of these Terms, the user will not be refunded any license fees or other prepaid fees, if any. Data enabled users can terminate their services by uninstalling the software.
Governing Law
These Terms shall be governed and construed in accordance with the laws of Nigeria. You agree that any legal action or proceedings may be brought exclusively in the competent courts/tribunals having jurisdiction in Nigeria and both TrueID and You irrevocably submit to the jurisdiction of such courts/tribunals.
